Virginia State Requirements
Virginia does not require a prescription or doctor's order for a DNA paternity test. Under Virginia Code section 20-49.1, parentage may be established by a written statement of both parents made under oath, signed only after each has received a written and oral explanation of the rights and consequences, and either party may rescind within 60 days. Once final, that acknowledgment has the same legal effect as a judgment. Virginia also gives scientifically reliable genetic tests showing at least a 98 percent probability of paternity the same legal effect as a judgment. For a result to be used in court, the test has to be performed by an accredited laboratory with a completed chain-of-custody form, which means samples are collected at a certified site and everyone tested shows government ID.
